7. Disclaimers and Limitation of Liability

The hypebet Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

7.2 Limitation of Liability

To the maximum extent permitted by Philippine law, hypebet, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

7.3 Maximum Liability

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have deposited into your hypebet account in the six (6) months preceding the event giving rise to liability.

8. Account Suspension and Termination

8.1 Termination by User

You may close your hypebet account at any time by contacting our customer support team. Upon account closure, you may withdraw any remaining balance in your account, subject to completion of any pending wagering requirements and verification procedures.

8.2 Termination by hypebet

We reserve the right to suspend or terminate your account immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or otherwise acted in a manner detrimental to the Service or other Users. Upon termination for cause, we may forfeit any remaining account balance, including deposits and winnings.

8.3 Effect of Termination

Upon termination of your account, your right to access and use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

9. Governing Law and Dispute Resolution

These Terms and your use of the hypebet Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

9.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be resolved through good faith negotiation between the parties. If the parties are unable to resolve the dispute through negotiation within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc.

9.3 Jurisdiction

You agree to submit to the personal and exclusive jurisdiction of the courts located within Metro Manila, Philippines, for any actions or proceedings arising out of or related to these Terms or your use of the Service.

10. General Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Service, constitute the entire agreement between you and hypebet regarding your use of the Service and supersede all prior agreements and understandings.

10.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

10.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

10.4 Assignment

You may not assign or transfer these Terms or your account to any other person without our prior written consent. We may assign or transfer these Terms and our rights and obligations hereunder to any third party without restriction.

10.5 Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
